Actor Chris Klein -- who was arrested for a DUI earlier this month -- has been formally charged and could be headed for jail.
The Los Angeles City Attorney's Office has charged the American Pie star with one count of driving under the influence and one count of driving with a blood-alcohol level of 0.08 percent of higher. If convicted, he faces a minimum of four days and maximum of one year in county jail.
"There is also a period of probation, fine of $2,000 and with DUI convictions there are usually AA classes that are part of the sentencing," L.A. City Attorney's Office spokesman Frank Mateljan said.
Unfortunately, this was Klein's second DUI in five years (he pleaded guilty to a misdemeanor charge in 2005), and it was an extreme case. A California Highway Patrol officer told E! News, shortly after the the actor's arrest, that Klein's blood-alcohol level was at nearly three times the legal limit. Less than a week after the incident, Katie Holmes' ex checked himself into a 30-day treatment facility in Utah.
Klein is set to be arraigned on July 9.
