Eric Dane and Rebecca Gayheart are doing their best to show the media that they can't just release naked videos of celebs and get away with it.

The couple, whose "sex tape" with former teen beauty queen Kari Ann Peniche made headlines last month, is suing Gawker Media for copyright infringement for more than $1 million.

In the lawsuit, the Grey's Anatomy star's lawyer states that Gawker was warned that posting the 12-minute video on its Defamer.com violated the couple's legal and privacy rights, but that the blog "went on to maliciously distribute an uncensored copy" of the tape anyway.

But Gawker's publisher, Nick Denton, doesn't seem to be worried about the legalities. In a Twitter message, the media mogul said, "To quote the great Marty Singer – Eric Dane's lawyer – if you don't want a sex tape on the internet, 'don't make one!'"

Hmmmm. He's got a point….
