Montana Judge Sentences Rapist to 30 days

There are many difficult things about this news story http://www.cnn.com/2013/08/28/justice/montana-teacher-rape-sentence/

Yet the part that seems to stick out for me is when the Judge said "It's not probably the kind of rape most people think about," Baugh said. "It was not a violent, forcible, beat-the-victim rape, like you see in the movies. But it was nonetheless a rape. It was a troubled young girl, and he was a teacher. And this should not have occurred."

I agree with him that it is still rape even if it wasn't overly violent but how much should the level of violence play a role in the sentencing and even if it should is 30 days adequate for "three counts of sexual intercourse without consent"?

I have been thinking about this story and that comment from the Judge and I am not sure what to think. A person I know has a 14 year old girl that had a sexual relationship with a 19 (almost 20) year old man. When her parents found out, they pressed charges against the man. His defense has been that she was the aggressor and when he first met her she had lied about her age. They found email and other messages from her that agrees with his account of the story. The prosecutor doesn't want to proceed and her parents are completely furious. They feel like their daughter was lured into this relationship by this adult male. I don't understand the prosecution of one person who does this and not another. Is it not against the law-every law-to have sex with a 14 year old? Why do some get prison time and life on the registry and others nothing?

Perhaps the prosecution didn't want to move forward with a statutory rape situation.  Maybe the laws need to change to indicate that a person under the age of consent is not legally able to provide consent just as someone who is drunk or otherwise impaired and that might provide a bit more clarity when it comes to charges and sentencing.

I don't think it's adequate at all. He was a 49 year old teacher, who definitely knew better. He admits that it was rape, so I don't understand the 30 day sentence at all.

Thanks for responding.   Thirty days isn't much but hopefully he'll think twice before he has sex with anyone else again.

That is unbelievable. There is a man at our church that got a prison sentence and time on the sex registry for texting and emailing a 14 year old girl. He never touched her. I don't get this sentence where the man actually raped the girl compared to what the man at church did.
