An argument over texting in a Florida movie theater ended with a retired Tampa police captain fatally shooting a man sitting in front of him, authorities said.

The former police captain, Curtis Reeves, 71, has been charged with second-degree murder. It's not immediately clear whether he has retained an attorney.

"Somebody throws popcorn. I'm not sure who threw the popcorn," said Charles Cummings, who, as a birthday treat, was about to watch the movie "Lone Survivor" at The Grove 16 Theater on Monday.

"And then bang, he was shot."

This is just horrible, I dont know how many times I have used my phone all the way up until the first movie previews start. Then make sure its off and quiet before the movie starts.  Why would he just snap so fast over something so minor. He shouldn't have even been a cop if he has a pistol finger like that.

The issue is slightly more complicated.  The old guy didn't just pull out his gun and shoot the texting guy for being annoying.  Apparently there were words exchanged, an argument ensued that got (as described by some) physical... after which, the old guy (as his lawyer claims) felt threatened and shot the texting guy in "self defense."

Seems to me we're going to have huge battles to come with gun laws. Here is a perfect example of a person legally owning a gun, was at one time held to in high esteem yet... he kills someone over texting in a movie.
