Supreme Court to take up same-sex marriage

The court's decision to hear challenges to both California's Proposition 8 and the federal Defense of Marriage Act could lead to a series of historic rulings.

The court likely will hear the cases in March and rule by late June on a series of questions, potentially including one of the most basic: Can states ban gay marriage? It also will decide whether gay and lesbian married couples can be denied federal benefits received by opposite-sex spouses.

Get out the popcorn this could get dramatic.
I know right off that there are two votes against the cases in the Court right now: Antonin Scalia and Clarence Thomas.  Justice Scalia has said that it would be “easy” to overturn gay rights rulings, and Justice Thomas, while not as virulently squeamish about Teh Gay as Mr. Scalia, tends to believe that the states are the only ones who can determine individual rights.  He voted to uphold Colorado’s Amendment 2 that outlawed anti-gay discrimination laws in municipalities.  I’ll bet that DOMA is the one case on which he’ll side with the proponents of federalism.

I'm expecting a big "yawn."  With 40 states banning gay marriage, it seems unlikely that the SC will do anything particularly dramatic.  Probably uphold states rights.

There is certainly a lot of hype now about the issue, and there will probably be quite a bit in the spring, but I don't expect anything too dramatic on the issue, but then maybe we'll be surprised.
