Fortunately the SJC has decided that state fair lending laws are not preempted by federal banking regulations. Hopefully this mean the judge in Georgia will have some impact.
In a victory for homeowners across this nation, the Supreme Court reversed, in part, and affirmed, in part, a Second Circuit ruling that had validated a regulation of the Office of the Comptroller of the Currency (OCC) that interpreted the National Bank Act to pre-empt state attorneys general from enforcing state fair lending laws against national banks.
