Final Divorce Papers Wrong?

Hi.......it's makesmehappy2004 "Happy"!

Do you want to hear this one? Got the final papers Tuesday. He had agreed, I agreed, papers were filed, attached Exhibit filed where we were BOTH in agreement on child support. He'd pay me $250 a month. He makes way, way more than me, but this was our agreement. We filed those wage statements also.

Papers came back Tuesday......IIIIIIIIIIIIIIIII have to pay HIMMMMMMMM the child support!!! I don't know if this was error or this is what the judge ruled because he said he had her more than 50% (which is a lie but I agreed to get it over with). Then the papers refer to our agreement which stated he pay me.

I'm so confused. Last night I thought I was having a breakdown. I had been crying for two days. The thought of them attaching my wages makes me sick. The clerk at the court claimed it was a state law for wage attachment. He and I didn't fill out the CSE papers because we didn't feel we needed it. He has been paying me on time with no problem. He's the one that called and told me the papers were wrong. He called an attorney and the attorney said we have to appeal. The secretary at the judges office said "oh, well, this is what happens when you don't have a lawyer!"

I'm just sick. I'm much better today than the past two days because he brought me to a point of almost a breakdown last night when it came to me getting what little bit I want out of the house. I just screamed at him that I hated him and I wished he'd die. It was the adrenaline that I had built up for two days. I hadn't eaten, I was a physical and emotional wreck. Of course, after he got me to that point of self-destruction, he did his usual passive self and said "you can take whatever you want." He's such a sick, sadistic, evil, vindictive bast*rd, then he wants to help me in other ways.

Anyway, I did fax the papers to our company attorney to get his advice. I have just never heard of this before. Has anybody? I mean, my God, he makes over $50,000 a year and I make $8.50 an hour. We have dd jointly but he wouldn't agree to saying that in court because he was afraid they'd make him pay according to his wages.

I just don't know if it was error (because he was the petitioner) or if the judge was just a vindictive b*tch. I had heard she's for the men.

Any comments?!?

See if you can speak with a paralegal or a legal aid attorney.

Thanks to both of you for your replies. Our attorney at work is going to look at the papers and let me know what to do. He doesn't have sole custody. We have joint custody. All through the papers we filed it said joint. I just can't figure it out, but I'll wait for the attorney to call me. I won't stress anymore over it. I just want everything to be legal because you just don't know what a year from now will bring.

Thanks again,
Happy
