Last week I got a restraining order against my STBX. Today was the day it expired and the date of the hearing to determine whether or not it would be dropped or not. Well, STBX never showed up for court. My atty filled out a year long order for me, however, I did have her put in visitation for him. The judge signed it and my atty is getting a temp custody order for me. However, my mother saw STBX at the store where he works and asked why he wasn't going to the hearing, did he just not want the kids or what. She said he thought it was tomorrow and had only gotten an atty yesterday. He said the way the officer explained it to him that he thought it was tomorrow. I have a saved voicemail from him saying that he obviously misunderstood the officer.


He would have to petition for another hearing and go back to court again to make any changes in the RO. Just keep your safety plan in motion as when he realizes that he has missed the date, he may get upset.
And even though you are pretty sure he misunderstood. Keep in mind that they are pretty explicit when giving a ex parte/restraining order and point out everything in detail so there's no way of misunderstanding.
That's great you got the custody set up as well.
Breathe don't panic. At least your lawyer went with you. Mine sent me alone. I luckily had an advocate from the local DV facility.
