Driving while holding handsies with your nephew is very dangerous. My brother texts while he drives. I yell at him all the time. It doesn't make him stop, but sometimes he cuts it shorter, because he hates conflict.
His decision to give his son his every whim is generally between him and his wife. I'd stay WAYYYY out of that one and let the professional therapist handle that one.
However, I think you were all correct in pressing the issue until he complied w/ safe driving. I would not apologize for that. I am glad he finally listened and for whatever reason motivated him DID IT.
However, I also think the way your brother spoke to you - as not sibling children in an immature squabble but as adults was completely inappropriate.

It sounds like your brother gives in to your nephew's every little whim. He's five and
