Hello there, writing about my husbands family. When there father died he left a business that his brother took over and ran into the ground, after his mother went to a nursing home his sister was made executor of her trust.His mother and brother and sister lived there lives like they were rich and only wanted the finest things. My husband on the other hand was a down to earth guy who everyone came to when they needed something done. They treated him like he was the gardener. His brother owned a house and lost it so his sister said here is Mom's hse give me 400.00 a mo for rent, full of antiques furnishings etc. It' a half million dollar hse. His brother acts like he's depressed to his sister and she feeds that by letting him do whatever he wants, my husband is not allowed in the driveway, things of my husbands still in his mothers hse were thrown into the street when he moved in. His sister calls it his hse and tells my husband don't make me choose, which clearly she already has. I know my husband feels left out and betrayed by all of this.

ALSO ALL $$$$ BORROWED BY HIS BROTHER, HIS DEBT HAS BEEN FORGIVEN, BUT MY HUSBAND'S HAS NOT. WE MAKE COMBINED THIRTY THOUSAND DOLLARS A YEAR. HIS BROTHER WILL LIVE IN THIS HSE FOR THE REST OF HIS LIFE AND NO ONE THINKS ABOUT MY HUSBAND MAYBE HAVING TO GIVE UP OUR HSE IN A FEW YEARS BECAUSE WE DON'T HAVE THE $$$$ THESE PEOPLE HAVE.

Has your husband consulted a lawyer to see if what they are doing is legal?  Did the trust specify that money was to be divided equally?  If so your DH could make a claim that his sis is not doing what she is supposed to be doing--that's really the only way to get the money.  The sis doesn't like him anyway so it's not like he shouldn't pursue his rights.

The best advice I can give you in this situation is to get out of it and stand on your own two feet. No one should expect anything from their parents, you are supposed to be raised by them only, and then get yourself educated and get a job to support yourself. Why would you want to be under the thumb of this sister? If you can't afford your house, sell it and get a smaller one. You have to live within your own means, anything given to you arbitrarily is a gift.
