Like the pp mentioned, the SSCRA should cause any court proceeding to be delayed until he got home. She could make a big deal about it before he leaves, such as agreeing he could have custody while he's here, but stating that she wants the kids back when he deploys, especially if she knows he has a deployment coming up. I've seen many families that have pretty much that exact arrangement set up. Then the kids go back to the soldier once they get home or right before they get home so they are there for the homecoming.

Actually unless the laws have changed, custody is NOT affect by Soldier's Relief and people have lost custody of their children while deployed. Your best bet is to talk to a lawyer. Next piece of advice is to document, document, document everything that goes on with custody or divorce cases. Take pictures, keep voice recordings, emails, etc. The more information that you have, the better off you will be in court. Just remember that you have to take the high road and not give the OTHER side any ammunition.

O she looooooves texting and e-mailing. Thanks for making it easy. Lol. I also love that my cell phone provider gives you a copy on your paper bill. I don't debate with her. Plus, she only starts with me when A is either unavailable or not responding. He has copies of what she sends him too.

Thanks for all your advice. We go next week for a hearing with a court mediator, to see if we need to go in front of a judge for a full proceeding. The court-appointed child psychologist is also supposed to have her report done. She just did our home visit 2 weeks ago. I'm freaking but it's the same chick who did it when we first went for visitation during the summer and Christmas.

I don't know your whole story either (I have been pretty absent lately), but I wanted to comment on something Tricia said, which was that you have to take the high road.

I haven't posted much about the backstory. It's quite lengthy. Basically, A LOT of dysfunction is going on in SD's enviornment. CPS has been involved (while he was deployed and before we got married). It's just a sad situation that we are both tired of watching SD live with when she doesn't have to.
