(since I'm studying HR right now) - They have to asks if it is okay with you to talk to your supervisor - If you are worried about it, you could just list another supervisory person who can give details about you - but if you say no they cannot discriminate against you.

CG- yes, everyone at my old employer found out about my A. I was in management and quit with no notice after D-Day and xAP was 'suspended' for three months. The employees were told the reason why. That was a year and a half ago.
Thanks for the input. Its a small company that does not have an HR director anymore, so I think I will just list someone other than xAP. I don't want him thinking about me and I don't want to think of them calling him.

Have the potential employer contact the HR dept. of your old company, if possible.
The conversation will likely be very cursory - confirming dates of employment, general duties, etc.
