When I first came back to town to practice, I was terrified to argue a case before my MM. I had seen him in court before, and was really impressed, so I had this image in my mind that he was the be-all end-all almighty prosecutor, and I would never be able to concentrate. Fortunately, it was not at all like that. I use my time to prepare for any case wisely, and cases that he is prosecuting are no different. I call his office and talk to him, the CLA's, and the investigators to try to see if we can plead it out. Then I take the offer to my client. They will accept it or not. If not, we go to trial. It all seems so simple (although I got a C in Trial Practice and Civil Procedure in Law School).
It almost invigorates me to argue a case against him. I feel this sudden surge of empowerment. It's really difficult to explain. I almost feel like he's looking at me as a totally different person.
More ramblings, I'm sorry. Anyway, here's a funny story (it didn't happen to me, thank God, but another local attorney):
"I was representing a client on a car accident/personal injury/insurance claim. It had gotten pretty messy, so we started deposing the parties. My client was a young woman who had allegedly sustained some pretty severe back injuries as a result of the accident. She came in for her deposition, and out of nowhere the opposing attorney asks her, "Have you ever had a sexual relationship with the Defendant?" To my complete shock and humiliation she answers, "yes." It turns out that the Defendant had contacted her after the accident to try to work out the insurance mess, and they ended up meeting several times to have sex. Kind of determined that her back injuries were somewhat exaggerated and I ended up withdrawing from the case."
I heard that one at lunch with some friends a few days ago. I hope it brought a laugh.
