Boy, I could really use some advise and support here. Long story made somewhat short is this...I took my ex back to court for a child support modification, he makes on average over the past three years $330,000 per year...i just started working after being a stay at home mom for years and I make $32,000 per year. His income is almost solely commission, although it's been steady over the years and that figure is the average. When we divorced he and i agreed on a child support amount of $1800 per month for two kids. This was not the courts calculation it was ours. So, in talking to my attorney he talked me into filing for a modification even though our state (ohio) has a cap on the income level of $150,000 meaning...child support is always calculated on this amount. You can go back to court and the judge can overrule that when there is a huge difference in household incomes as in our case. Well, i just got the decision back and my child support is going to be LOWERED....I'm in total shock of this it's being lowered by $350.00 per month. I just don't understand how this man can make $330,000 per year and only pay $21,600 (old amount) and $17,616 (new amount) per year in child support. How in the world is this fair and can anyone relate. Plus they ordered to be back dated to last year...meaning I could end up oweing him money!! This is crazy and i'm just beside myself. I feel like the judge just doesn't like me or something. And i'm really, really concerned because we are also in the middle of a custody battle (going to court next month for that). My ex makes so much money and is so arrogant about it....i feel like he just walks from everything. I'm so tired of hearing from men how they get raped by the system and how it favors women. Not in my case, not at all!

Can anyone offer me any insight or advise? Thanks

I'm sorry you are dealing with this. I have no advice. Men can be such pains when it comes to cs. My stbx's boss told my dad that stbx asked that when cs starts getting garnished he get paid cash so I can't get as much. I have no idea why he would do this. I have no idea why his boss told my dad he would do it. He does it for a couple of other guys so their cs is less. Good luck. Maybe you lawyer could explain it to you. That is where I would start.

that sucks!!! I am assuming that it's the state cap that bit you, not him.
Are you getting alimony? You should be with the salary difference and because you were at home with the kids!

HUGS!!!!

I can't offer advice, but just outrage that the courts would do this! I am SO SO sorry and appalled (sp?). He is harming his children. It is stunning.
