Changing lawyers- can I, should I? (m)

Although my divorce has been final for almost 2 months, the real mess is just beginning. I was not too pleased about the attention and thoroughness given to my case to begin with; my saving grace in it all was the fair judge we got at final hearing. Now my XH is 2 months behind on CS, and has entered a petition to revise said support due to the fact that he has all of a sudden become "unable" to work. This was filed last week, when my lawyer SHOULD have been filing contempt of court charges. She told me to wait another week, and then didn't even warn me his petition was filed (I found out in a letter mailed from her office.) My ex already owes her $3000. If he is found in contempt then he will have to pay those legal fees as well. I have another lawyer I'd consider working with, although I'd have to come up with another retainer, I'm sure. It is critical to this case that I get good representation. I am about to lose my home and don't know where my kids' next meals are going to come from. I believe he is committing insurance fraud, and possibly lying about the fact that he is not getting some sort of payout. I faxed my lawyer a letter today asking her if she still wanted to take my case since they have been too busy for me. If I change lawyers will I be able to get my file from my former lawyer? I need to move quickly before his motion is given a court date. HELP!

Hummm..... you should try to stick with the same attorney, BUT if they answer your letter stating they they are unable to give your case the attention that it needs, they should release copies of your file to you, and possibly even refer you to another attorney.


You might also check with your local child support enforcement office.
