Changing lawyers mid to late process?

I filed October 15, 2007 and our pre-trial hearing is scheduled for April 18 - just a month away. I have very big doubts about my lawyer and whether he is tough enough and well versed in some of the financial details in play to see this through and make sure i don't get screwed over.


My STBX has it in his mind that he is entitled to 65% of the marital assets and that I should have to pay 65% of the debt.

There's nothing wrong with seeking a second opinion. You don't have to change lawyers. Paying another attorney their hourly rate won't hurt you. If you decide the new attorney is more savvy or confirms your needs, then you can think about changing lawyers. Be prepared for delays in process however as your new lawyer will need time to become familiar with your case.


Also, Illinois is a "community property" state. Divorce laws state an "equitable split" of debts and assets, this doesn't necessarily mean 50/50.

As a divorce laywer myself, I have to say that I just hate it when someone comes in a month before the PTC and wants to change lawyers, unless the court will grant a change of date for that reason.
