Child Custody

So basically I got married to this guy in Florida who I thought I knew but he ended up stealing my debit card and lying to me, once I found out that I was pregnant I realized that I couldn't stay with him because he wasn't supporting me. I moved to California with my family and have just filed for Legal Seperation because I cannot file for Divorce until November the same month that my son will be born. I want full custody due to the fact that since I have left I kept in contact with my husband and he has neglected to help me or even send twenty bucks to begin buying my son things he will need. He has threatened me saying that he will get custody but now he is dating some girl before I had even filed for Legal Seperation. Will I be favored and granted Full Custody? Seeing that I am the primary care provider and he hasn't supported me?

First of all, no judge is going to award custody of a newborn baby to the father--will you be nursing the baby?

I largely agree with musiclover12. It is likely that the court would rule in your favor. But make sure you have documentation sufficient to back up each claim you make and choose an attorney carefully.

Here is a piece of advice that I've heard from professionals in the family law field, repeatedly: "don't tell your soon-to-be-ex what you're going to do or not going to do. "

I am sorry that your husband has left you in such a poor situation.

Protecting your son's best interests, and standing up for your rights, are *crucial* in a marriage dissolution.

Best wishes!!
