Child support - Get his tax refund?

My XH is in arrearages in child support. I was told in MI that if they are behind at least $500 then I should get his refund IF he files taxes. yes my XH is that stupid NOT to file. But how will I know if I am getting his return? Will they send me a letter? Because my XH is "self-employed" which I don't believe but have no proof. My child support is set up as direct deposit so should I just be watching for deposit?

Any help with this?

If you were married all of 2005 or most of it, his tax refund is half yours. I'm sure of it. Have you filed joint or married filing seperate? Regardless, his tax refund is half yours.

I'm in GA and was advised by my xh that the IRS advised him that his tax refund (about 3/4 of a year of child support) will be deferred to me to help him catch up on his arrears balance. I mentioned this to the GA OCSE office that I work with locally and they confirmed it--they could not advise me of such if I did not bring it up, but they could confirm the information. I was happy to receive the confirmation, as I do not trust my xh further than I can throw him (and he weighs over 250 lbs)...

Does MI have a website set up where you can go online and see your case? We have that here in GA and the income tax information shows there, even though I have not received any other official notification, written or otherwise... Mine is also direct deposit, so I am going to go ahead and keep checking my account... it should be here within the next several weeks, I would assume...

If you have filed with the OCSE, call them and see what they say... see if the information you have below is correct... see if they can give you any information on your account... in my case, I had plenty of reason to complain... more than $10K in arrears (pre-tax refund) and have not even received one month's support this last 12 month period, if you add all my payments (all two of them) together... the last time I got anything was about $100 in November... so I had to say something...

No MI does not have a website to check your account. But on another board I posted they said I had to fill out a form in order to receive his refund. No one informed me of any such form.

So is this the same that you are telling me? That unless I asked about it then something would be done otherwise if I don't know to ask about it then I am screwed?

No, that's not exactly what I'm telling you... but like Karen said, your local Office of Child Support Enforcement must be in the loop and aware of the arrears balance, in order to take the steps necessary for you to get any refund he may have coming his way... I never filled out any forms, except for the ones when I first filed with the local District Attorney's office (my xh lives out of state, so the DA gets involved), as they are working with the other state to make things happen...

I can tell you that I filed for CSE in June of 2004 and even though he was several thousand in arrears this time last year, I didn't see his refund... I don't know what is different this year from last, except that I have been advised that each year when I file my taxes that the IRS can and will do this to help CP's get the child support that they're owed...

If I were in your shoes, I would contact your local OCSE and see where you stand...
