DH found out I was planning on leaving

My plan was just to leave after I file taxes. That way I know I will get 1/2. I had taken my notebook with all my plans and notes with me to the laundry mat today. I stuck it in the bottom of one basket before I came home. I did not think anything of it. DH was acting weird and then decided to take a load of trash to his mom's (big items we have to pay extra to have picked up/MIL gets it picked up free). I did not think anything of it. After he left I decided to put up laundry. When I got to the bottom of the basket it was gone. I asked the kids and they said my two yr old had dumped the basket out while I was cooking and DH picked it up. Sure enough I found the book on the desk. I hope this does not change my plans. I asked him twice after dinner to run and get his w2 from work. (they were suppose to be in today) and he said no. I really need that money to move out on. I am afraid he will file separate and I will lose out.

How about calling your lawyer and ask of the possible implications? what can he do?
The way I look at it, it makes sense to file at a moment when the split can be calculated easily - and it should not change dramatically... but of course, the fine lines of the situation should be evaluated by your lawyer. It also depends on what is the law in your state of course...
