Is anyone familiar with the divorce laws in Louisiana. My question is about separation (there is no legal separation in LA) . I know that you need to be separated for 1 year when you have minor children. It has been 6 months, problem is Christmas eve night I let my soon to be ex spend the night. (separate beds, separate rooms) so he would be here in the morning when the girls saw what Santa brought. I now realize that it was stupid and may have given them false hope. And it irritated the crap out of me with him being here, reminded me why I left in the `1st place. Now to the point of this post. Will we have to start our 12 months again since we were under the same roof. I had one friend that said "no" as long as we didn't have intercourse. I have one that said it doesn't matter, that my year starts again. I'm hoping someone on here is from Louisiana and knows this information. Louisiana has suck messed up laws....

Hi,

True, only an attorney can answer your legal questions. Based on common sense, I don't think one night "sleepover" in a separate room can be counted against your separation time, however, I don't know what LA considers "separated." Again, a qualified divorce attorney is the only one to ask.

Thanks, I will call a lawyer tomorrow. I hope it doesn't because I'm ready for this to be done. I'll let you know what I find out.
