I don't know if anyone has the answer to this question but I am going to ask anyway. A friend of mine is wanting to get a divorce he has tried the dissolution route and went to court and she said no. If he files for divorce and she is still saying no can he still get the divorce, will they make her sign the papers and it be over??

In the state of KS, I don't know about anywhere else, Yes he can file and get his divorce no matter what she wants. How do I know? My husband of 15years did it to me. The way it was explained to me was "irreconcilable differences=Him wanting out and her wanting to stay." Hope this helps. Hugs, Brenda

It's actually the state of Ohio but I guess he still may have hope.

Well, the "marital dissolution agreement" is part of the divorce process.... but if he actually files.... files with the courts to divorce her.... as far as I know, she'd better get on the bandwagon to respond and work out a fair split, or the court could rule totally against her.
