I am in the process of divorce..my STBX still lives in our home and refuses to pay bills...i have court ordered support which is only $820 per mo..anyways he refused to sign our JOINT tax return so i forged his name and sent it...It had been a while so i called the IRS..they said the check was mailed over a week ago...i believe he got it from the mail and cashed it...i dont know what i can do..my attorney hasnt returned my call yet..does anyone have any ideas on how i can get my half?? I havent confronted him on it yet...I am just sick over this as i recently found out he fathered a baby with another woman and we are not divorced yet... :(

Forging his signature was illegal. You may just want to forget it so he doesn't tell the IRS. Next time file married filing separately. I hope this doesn't come back to bite you in the butt. Good Luck! Hugs, Brenda

It was on my attorneys advise to go ahead and sign his signature...since we are still married she said to file jointly...i cant just let it go it was $8000!!! ahhhh

Do you have power of attorney? If so, you didn't forge his signature, you signed using power of attorney. If not and your attorney advised you to sign it, then your attorney did advise you to do something unethical and illegal.

If the return was joint, then the check would have been made out to both of you and he shouldn't have been able to deposit it into a solo checking account or cash it without your signature. Of course, he may have forged your signature.

I don't know what you'll gain by confronting him. . .if he forged your signature why would he admit it. If he didn't, he'll know you forged his.

I hate to say it this way. . .but you've got a mess on your hands. Hope you can resolve it somehow.

I would still be very afraid. I understand needing the money. Did you at least note on the return that you signed it for him? Otherwise I am afraid it is forgery. Please becareful. Take care of you. Hugs, Brenda

I'm not sure that your attorney's suggestion to sign his name on the return was ethical.... however, if EX got the check and "cashed" it.... well now that would negate you signing the return (he's basically admitting that he was OK with the return, in my opinion, if he did endorse that check)...... however..... if he did "cash" the check, that would mean that he forget your name on the endorsement.
