My ex -hubbies girlfriend has twice while on the phone with me made statements to me that make me think she wants to brawl. The first time she said she would "Punch me out," if I came to her house. It was my visitation day with my daughter and I offered to pick my daughter up at her home. My ex and her ignored my calls then finally she lashed out while my daughter was in the room saying she would punch me out if I came over, on the phone.I never ever met her nor have I ever been rude to her. I was hoping we could be friends for my daughter. Then a few days ago I called my ex's cell ph, she answered it and yelled"What the F---k do you want now?" I calmly replied,"I'm calling because Kayla cant come over tomarrow I have to do something important",she said yelling"You always have an excuse for everything..all the time" I just hung up.I could not believe her tone of voice.I had to go to the courts to file papers for my sons custody. My ex has only been dating her for 6 months. She tells my daughter what to do, patronizes her, critisizes her. My daughter is trying to do as she says but frankly I dont want my duaghter even at her home. We have joint legal and physical custody. Do I have any rights to keep this dragon away from my daughter or should I get a restaining order since she threatened me in front of my daughter? Or should I throw a brick through her car window? I actually cried alot after that and told my ex. He yelled at me for being on disability and having a new son out of wedlock. I cried for days. I guees my duaghter is going to suffer because of a pair of selfish immature grownups. I told my daughter to tell Rafella, not to talk to me in a bad way anymore because I am anice person. I think she is jealous because my ex and I call eachother alot and get along pretty good. Not any more. I decided to not answer any calls of his till I get an apoligy.I think my ex is using his girlfriend to piss me off because I got the son tI wanted and my boyfriend has been a jerk to him, although I didnt like him to be. He was anyway.

I'm not sure that this is enough to warrant a TRO, unfortunately. If she were to make these threats in person, it would be a different story. It sounds like she's a fairly new gf? Keep a log. Talk to your attorney about what you can do.
