We came from court today and my ex got yet another small victory. This is the second time he has managed to get the child support amount reduced. He's such a loser. First back in March of 2005 he lost his job. So grounds no.1 for the reduction. He started going to mechanics school to learn skills in working on cars so he can supposedly get a better job than the store manager position he had at Rite Aid Pharmacy. He got an extension on his unemployment for being in school which ran out last week and NOW, he is in work study earning $8.00 an hour and can only work 20 hours a week. So based on that grounds no.2 for getting a second reduction on the child support.

The judge asked him how much does he think he can afford to pay in c.s. and he said 30 or 40 dollars. The judge made it fifty and he said he cant afford that. He was asked how much he pays in rent - $700.00. He said he get assistance to pay it, the judge asked from what agency and he said no agency, so judge asked do you have a roommate, he said no, then he asked so someone is giving you cash to pay your rent? He said yes, the judge asked who, he said his gf. So the judge said she lives with you? He said no. He's such a liar. If she isnt living there and is paying his rent then she's an a$$.

He supposed to graduate in Dec. of this year and claims he's been looking for a job but hasnt found one yet. So the judge did tell him that he is concerned that he isnt working yet. As for him trying to get it less than the $50 the judge told him no. Because what would he do if his gf stopped paying his rent? He'd have to get a job somehow.

Im really struggling as it is and he pulls this. Then wants to whine about not being able to do $50 a week. That's peanuts with all my expenses. As for me he told me if I feel that the baby's needs arent being met since this order I can come back for a modification.

As if things werent already going downhill, now I found out that my rent is being raised to $1300.00. I cant afford that. Can I go to court for a modification to the order for this. Would it go in my favor? I dont know. I mean doesnt the father's have to contribute to the living expenses and rent for the child?

Do any of you know how the NY courts view this. I gotta find out. I dont know what Im gonna do.

That stinks!


I do know that expenses are considered in some cases... but it sounds like the judge is pretty much on his last leg with EX.


I'm sorry that things didn't go any better.

Thanks so much. All I can do now is once the increase goes into effect which is I believe in Feb. or March is go back to court for a modification. I dont think anything will happen but I just have to pray.
