Two months ago HE tells me he wants a divorce, he just can't live like this anymore. BTW I'm a monster and he does nothing wrong. Well, then he changes his mind, I say okay, let's work on things, well the monster has changed her ways and he has, too. Now he takes off when he feels like it, sometimes doesn't come home till the next day. We have 2 beautiful children and I am mentally drained. It is not going to work. He will not leave, says he has nowhere to go. He does, his mom lives alone, she could actually use someone there with her. I think it's just his copout not to leave. How can I force him out, is there legal action I can take. We do own a home, which will be sold, but it's not a safe and healthy environment as long as he is here. We live in Pennsylvania, anyone sure what the laws are. The children would be staying in the home with me. I do not have anywhere to go with 2 children and uproot my son from school. The easiest answer of course would be for him to go. Do I have to file for divorce first? I haven't seen a lawyer yet because it's been such a rollercoaster for the last few months, I didn't want to waste the money. But the disrespect he has shown me, has forced me to make the decision that we are no longer to be together.

You can do exactly what my ex husband did to me. He brought home papers on Friday afternoon that stated he had filed for divorce, that I had 24hrs to get out of the house or the police would remove me, and took my children away from me. You do not have to have an proof that he is unfit or abusive, the judge won't even ask why. I was amazed to find out you could do this. I didn't even know my ex was unhappy until he brought me the papers. I had no idea he wanted a divorce. We had never discussed any of it. It was a total surprise. It is very cruel and mean, but I am proof it can be done. Good Luck!

You should at least have a consultation with an attorney to find out what your rights and responsibilities are.
