I'm sorry you are finding yourself in this position. It's always best to file something immediately after a separation to protect yourself legally.


Are there any lawfirms that will do pro bono work or work at a lesser fee? You can call your State's Attorney's office for a listing for your state. You can also look up laws in your state so that you can go to court informed.


The first court date is usually to obtain an official court date (show of just cause). You present your "case" and then the judge will give you a return date. Have you notified your stbx of this court date? Paperwork will be needed to be filled out (Discovery of Assets, etc).

I have a copy of the petition that needs to be mailed to him. They did not give me a court date.

try this website -A1 Paralegal. They are in Pennsylvania so I don't know if they will work but you can try, or try to find a Paralegal service in your area. Paralegals file all of the paperwork for divorce, seperation, custody agreements-they just don't do any negotiating for you. You and your husband have to agree to all terms, they will just file the agreement swith the court for you. You said that you both had been getting along up until now-try totalk to him and see if you can work it out- I may have missed something but why did he not want the kids to be homeschooled anymore-is it a power play or does he have valid reasons? If you can talk to him and come to an agreement, a paralegal will be the best way for you to go. If he refuses to talk then you are going to have to get an attorney-the sooner you file paperwork the better. I totally understand the financial strains of attorney fees but if he gets his paperwork in first you are going to have a hard time challanging him. I hope you both can talk and agree on things.
