I had to fire my first attorney as well. I basically just found other representation, asked for my file and my new attorney took care of the rest. Make sure you get a copy of your file. Also, did you sign a retainer agreement ( if one was paid ) ? If not, you are entitled ALL of your money back. My new attorney told me this and I asked for all but the filing monies back. I got it too! Apparently there is a law that states you must have a retainer agreement signed when you pay your retainer, otherwise you get your money back. I would have never known this if I hadn't talked to my new attorney before I fired the old one.

My suggestion is put your feelers out for other attorney's first, before firing your old one. See if there is a difference. Ask questions, really get a feel for the possible new one. Also, make sure you feel good about the new one... go with your gut.

Good luck!
