I went to see an attorney this morning. This was so liberating that I would almost call it fun. STBX is still living here but there may be an end in sight. She confirms that, if he is true to what he has said, it is a better deal than I'll get in court. Basically, sole custody (or at least primary physical custody), the 403(b) (like a 401K) and 1/2 of our savings. She suggests that I have her (or someone) right up a separation agreement and then present it to him. He could/would then leave the house and I would use the money and 403(b) while I look for a job. Financially this is not good, but it just isn't good any way you look at it. She suggests that I do it soon before he retains an attorney since he has said that he doesn't want to spend the money, but may change his mind over time. So... I think I'm going to go for it. I could survive for several months off the money and the liquidated 403(b) while I look for a job. She suggests I take when he is offering because it would be worse with litigation even though I would be waiving rights to spousal support. I am so excited to feel somewhat in control. I cried once, but only when I was talking about my kids. At the moment, I am SO OVER the rest of it.
