is a witch... or is it a ... hmmm...

I really can't celebrate outwardly at home, but have to share my news. I have been extremely frustrated with the Office of Child Support Enforcement here... even though I filed in June of 2004, I've had very limited contact with them at best, and haven't even received a full month's child support, if you add up the two (measly) amounts I've gotten since this time last year... I'm about $200 shy of a regular month's payment with what I've received since the end of March last year...

Last Friday, I had the day off and figured, what the heck, I'll call the statewide Customer Service number, and see how it goes. It is tough because xh is in another state (LA) and they are the enforcing state, but my goal on Friday was to get GA to light a fire and see how it spread...

So, today, I'm surprised by a phone call from our local District Attorney's office (since he's out of state, that is who I've had to file with)... they advise that LA attempted to serve xh with contempt papers on March 24, at the address on file. They cannot verify the address on file is his, though, because the house is in his fiance's name and he doesn't have ~anything~ in his name. They were advised that he does not live there. Now, this is the address where I send things to xh from Joey and I've never had anything returned... it is also the address from which child support checks used to come, before I had everything go through our respective states...

LA is aware that he is a New Orleans police officer and are doing the employment verification at this time. I was also advised that they have currently suspended his license... which makes me laugh in a sad way... he's an officer with a suspended license... maybe he can give himself a ticket...

But here's the good news... I will be receiving money at some point in the (hopefully) near future... the CSE office was able to verify that I will be getting xh's tax refund... now, if he's filed taxes... which he has or I wouldn't be getting the refund, can't they confirm his address using his tax forms??? hmmmm... It will be a substantial amount... about 3/4 of a year's worth of support... I was hoping that when xh said last week that I would be getting it he was telling the truth, but I don't trust the man (nor has he given me any reason to trust him...), so it was great to get that confirmed!

Anyway, I just wanted to share... I'm hoping his employment verification comes back soon and that CS starts becoming much more regular... My last payment was just over $100 in November... Keep your fingers crossed!

I think it is great that someone is helping you to get the CS due to your child. You'd think that being a police officer they would just garnish his wages and take the desicion making out of it for him. Is this an option? I don't know much of anything about how CS works. We have not crossed that bridge yet. We are still waiting on our seperation agreement from the attorney...according to that my stbx is going to be paying alimony and child support equivalent to 1/3 of his income until I remarry (get this, he put in there that I can co-habitate for 6 months before it affects the alimony...isn't he generous? LOL)

Everything looks great on paper, it's the enforcing it that is the hard work from what I'm reading and hearing.

My fingers are crossed for you, Julie!

I't'd be great if you get that tax refund $$. I should think that as a police officer, he would be more conscientious about payment than most people. Don't non-payment issues get him in trouble with the Department? Course, I guess NO has bigger fish to fry.

Julie, that is AWESOME news! I hope they can get this child support situation resolved for you ASAP. You have already waited long enough for this. It's great you're going to be getting his refund check! I hope it helps and you get the payments you're entitled to very soon.


And an officer with a suspended license? I'd like to see that one ;0)

Thanks... I am excited that this day is here... the enforcing can be the tough part... especially if you're like my xh and keep everything out of your name, so there's no proof he's anywhere... Its harder in my case too because he is out of state, and in LA at that, with recovery from Katrina and everything else going on...

Fortunately, I'm not in the position that I have to depend on the support... which is good, since he's so good at sending it right on time (he's never paid a full month and he's never been on time, not once)...

As for enforcement, I knew that my xh wouldn't pay... as pathetic as it is, I know that CS is one debt that cannot be forgiven by bankrupcy, etc and I feel that it is my job, as my son's mom, to hold him responsible, financially, especially since he does next to nothing for him otherwise, living several hundred miles away and the most action ds gets is a phone call, completely random and never predictable... I filed for full enforcement just a couple of months after the divorce was final (when he was all ready 6 months behind without making ANY payments)... and am glad that I did, as it can take so long to get going... we were told to wait 6 months before we even should call and check status...

Anyway, good luck with your settlement agreement!

Yeah, I was actually surprised that he even got hired on, since I filed for full enforcement more than a year before he got on with the NOPD... you're right though, I'm sure they have bigger fish to fry...

There is an image of my xh as a bicycle cop that I cannot get out of my mind now, since, you know, he can't drive apparently... am I evil or what?

Seriously though, I do hope that he doesn't lose his job... is much easier to have him pay when there is money coming in... just garnish the heck out of his check... :)

Thank you... I was truly bouncing off the walls yesterday... and a co-worker of mine got a similar refund from the guy who's not paying support for her child today, so she was beyond excited, calling it Christmas.... its exciting to know its finally on the way...

I'm honestly hoping he doesn't get canned... it is so much easier to get money when he's making it... but it is completely out of my hands... I just filed for enforcement because I knew how my xh is/was and knew that without enforcement I'd never see it...

And I keep having this vision of a bicycle cop, since the license is suspended... I know, I'm evil...

I seriously almost called you last night so we could chat about it--I was that excited... it was too funny...

It is ironic the different sets of rules there are for "us" and "them," isn't it? Since they're in the middle of the employment verification process with the NOPD, I'm wondering if "more fun" is on its way. He got REALLY upset the last time he was served at work--for non payment of Child Support back in November of 2004.... I wonder if they'd do that again... hmmm... even if it doesn't happen, the dreaming sure is fun... :)

I'm going to keep making the calls... now that I know exactly who to call... that's what I loved about my old schedule, with my every other Wed off... the last Wed I was off every month I'd make my calls and get all that squared away while Joey was at school...

Truthfully, I hope he doesn't wind up losing his job over this... it is so much easier to collect while he's gainfully employed... just garnish the heck out of his check and that would be peachy for me!

OMG... a Jack... on a Jack... how freaking appropriate!

And you're right... just because I'm sick or stressed or busy with work or whatever, doesn't mean that Joey doesn't have needs that I need to continue to fulfill... and my job can't get in the way and I have to put him first...

and there's no way he'd be anywhere else... he's a smooth one though... knows that he can make my heart melt by telling me that I look beautiful today.... (so he does it every day!)...
