I moved within the last year with my H. Now that we are about to separate, and I am truthfully considering divorce, I have a practical question. We married in 1 state, and now have moved to another...where would we file for divorce? With the state we married in or where we have our last shared address? No one I know has the answer to this question- have any of you been through this?

Just wondering. Starting to feel like I need to get my ducks in a row, it looks as though a divorce is my answer and the questions I have (all kinds) are too numerous!

In my state, as long as we have lived here some symbolic number of months (like 3), we divorce in this state. I suspect it is similar in others, but the number of months of residence would vary?

Just google (My State) Divorce Law and you should find it easily, or call your County Court Commissioner.

thank you. I googled it and right away found the info I needed. I think, if I understood it correctly, we have lived in this state long enough to file here, if and when the time comes.

It doesn't matter where you got married. You must file for divorce in the COUNTY in which you reside at the time of the divorce. You can file or he can file. Talk to your local County Clerk for details on what your county requires for filing.
