Does anyone know if under a legal separation your auto insurance can remain as is? Both our names are on the two cars, but his address will be different. I know you can;t keep the auto ins as is if you divorce.

What state are you in? My state doesn't have legal separation, but I'd be happy to search around and see what I might be able to find out.

I just talked to my ins agent about this last week because I had the same question. In TX anyway, you have to stay on a joint policy until the divorce is final. (60 days after filing, in my state) BUT what they did offer to do for me was "split" the policy off so I'm only paying for my coverage. Unfortunately if one of us wrecks our cars, we're still liable for each other till the divorce is final. Hope this helps.

That's interesting. We split our policy before our divorce was final, and we were not liable for each other once they were split (maybe I'd be liabile if someone sued him and I was married to him, but I wasn't liable to the insurance company for his policy). You could certainly cancel one car and open a new policy for that car with another insurance company, that would be another option I would think. Either way, it's a good idea to ask the insurance company. They would know.

I am in NJ. My insurance said in order to have my own policy on the car I had to register it in my name and be on the financing. Currently it is in his name and the financing is as well.
I will wait until after everything is final. I am seeing my lawyer Mon. I was wondering if legal sep had all the same protection as divorce re the kids etc.

My agent told me that once the divorce is final, the policys must be seperated.
