A separation while under the same roof, yes. At least in VA. It is hard to establish you are truly separated, but it can be done.
You need to work with an attorney.
If you have agreed to part, fine, but that doesn't mean a precipitous move out. Work out your plans first since it sounds like you can work together--make a custody plan (especially with a disabled child), make financial plans and then work with a mediator/attorney to draw them up.
That gives you time to find him a good place (nearby?) to live and to get your house ready to sell, etc. You've been married for 6 years and working in it for one year. Take a few months to plan the separation.
Divorce is a technicality that can follow once all the details are worked out.
In VA there is no legal separation, but we can have a legal "separation agreement" that would act alot like a divorce. I don't know if I'd qualify for additional government aid with a separation ...

Talk to an attorney!

In Maryland, divorce can either be uncontested or contested.
Thanks so much-- your advice really did show me that what we are doing is the "right" thing to do and we are thinking wisely.
Thanks again!
