I wouldn't wait--I'd file for sole custody now--and I really hope that w/ the supposed 50/50 visitation it doesn't mean that he's not paying you child support.
I agree with Music. Call your divorce attorney and tell him/her what's going on. Ask what your options might be for custody and what's involved. I think you have every right to be concerned about your children's welfare at all times, and certainly when they're supposed to be with their father.
It sounds like your EX just asked for joint custody to avoid paying child support (right)? Or, you figured why fight him about it. Now this.

If you do end up taking him to court for custody or even to decrease visitation then you should also ask for an increase in c.s.
