My STBX has told me over and over again to file, so after telling me how lousy I was as a parent and he was taking my rights to my DS away, I retained a lawyer. He is overseas currently. When he arrived in the states he was served. He immediatley stated moving money and then items from the home. I had left the home during his stay because of his mental thrashing of me. So he proceeded to remove even more stuff, mostly my personal stuff because of his anger against me.

What does your lawyer say about the power of attorney? I think that you can access if you do have a general power. Did your lawyer say that it would be move that would make you look unfavorable in the eyes of the court? I wish I had more advice. I am sorry you have to deal with such a SOB.

I went through something similar. When I moved out, I left my ex with most everything. And unfortunately, as the divorce turned sour, I was never able to get back in a get things I wanted - pictures, Christmas decorations, etc. Also, I wasn't able to afford extra attorney fees to fight for these items.

These situations are hard if one party's not being reasonable. HUGS!
