I'm always leary of one lawyer representing both clients, because there really is no way that one lawyer can look out for both parties the way that he should... If I were you, I would get another attorney to represent you and look out for the interests of you and your children.
Jen,
These are legal questions that need a legal expert. Hire your own lawyer. You'll find the money well spent for someone to review documents, present issues you can't see (or won't) and provide you with the information you need to make an informed decision about the legal end of your marriage.
"Getting it over with" is a common desire among all people who divorce. Too often I've seen people on both sides of the break up later regret they put "getting it over with" ahead of getting their fair division of assets, support, child support, and other issues. If you're STBX is so agreeable to things now, then he should have no objection to having those things written out in a divorce agreement, one that has been reviewed by your own laywer.
And remember, you can hire a solo attorney to do your divorce, but the attorney can only really represent one of you. In this case, if your husband is paying the bill, it's your husband. Be smart. Hire your own attorney. Even if all you ask that person to do is review legal documents before signing.
