Since i don't know all the particulars of your case, all I can say is get a good lawyer and have the court appoint a guardian to investigate the situation, preferably the guardian should be a psychologist or social worker.
I am shocked that a state would give a step parent custody of a 5 year old.

He doesn't exactly have custody...unless in your state custody means the same as parental rights.
