Please help....I dont know what to do. I think my x may be planning on taking my 8 yr old son...taking as in parental kidnapping. My x has a GF in california...we are in ohio...and i'm hearing from my son that daddy says we are going to california the day after my bday...which is monday. He has not told me about this, he does not have my permission, we have shared parenting...Does anyone know what to do...he's done this before but never left the state and usually returns him in a day or so...it's a constant stuggle. Every time i contact the authorities they tell me it's a civil case and they can't get involved. I dont know if that is because my son is still in the same state or because of my x history with returning after a day or so.. We are in the middle of a custody battle which my ex is going to lose, and i think he is freaking out because of that...we go to trial on the 20th of this month.Please does anyone know anything about this. My atty plain sucks at returning phone calls.

Yikes. I dont have any experience with this but will give you my instictive response. First of all, you need a new attorney. Doesn't your custody agreement stipulate that neither of you can take him out of state? Can you get a court order, retraining or otherwise? I would not let him out of my sight. Don't let his dad come to his bd. party. Hide him until you are able to get someone in the legal community to help you. Do you have friends or family where your son could safely stay? Keep your son away from his father at all costs. You can always have the bd party another day. Your son may be upset but not as upset as he'll be if he finds himself in CA and Mom is nowhere to be found. Good luck and God bless. Let us know how it turns out when it's over.

Get your son a cell phone that he can keep in a back pack he carries. Program it with important numbers. I also agree with other poster - be sure your son knows your full name, address, and telephone number. You would be amazed at the number of kids who don't know their parents names.

Get a GPS(global positioning system) and put it in whatever bag or back pack he will have with him. MEZE mom

many cell phones have GPS capabilities :-)

I know cell phones have that capability, but if dad is "kidnapping" the child, don't you think he would dump the cell phone that mom has given to the child to call her? Hide a GPS in his bag, in a side pocket that isn't used for anything and would go unnoticed. The GPS won't ring and alert the dad, it will just quietly track the boy. MEZE mom

perhaps... but my guess is that there are lots of people who have no idea phones can do that... or even what "GPS" is.

Thanks everyone for the advice...Here's an update...Today is my son's Bday (8) and when he came home last night from the weekend with his dad..he said (son) that they weren't going to california now...I'm like, okay...but not unlike my X to change plans last minute...But I'm still going to be on guard. As far as the cell phone idea...it's a great one, but I know my ex would take it from my son...he used to do that with my daughter, she's 13...and refuses to go to her dads now because of all the drama he creates. So, because of past behaviors...I just know he would take the cell phone from my son. I have another call into my attorney...but am looking for a new one...One, that actually returns phone calls. Ill keep you all updated if anything comes of this...
