I told my good friend, who just divorced an attorney (UGH!) that I would ask here ...


Her X keeps deducting $ from child support checks, for "expenses".

I don't think he can unless it's agreed expenses. Otheriwse couldn't he just decide to take the kids to Disneyland and not only deduct, but SEND her a bill for the remaining amount? "Yeah! Little Billy NEEDED that $200 gold plated Mickey statue. Pay up, woman!"

I think she should contact her attorney. It's expensive, but in the long run will save her a lot.

read the court order all the fine print. In my court order it states that what they do on "your" time you pay for out of your pocket. It states it but not exact words. There are always gray areas when it comes to court orders. But I do not think that can happen. CS is support given to the other parent to help raise the child. Not to share that money when the child has an activity. Good Luck I know how expensive it can be. I am treading on thin ropes myself and wishing I had the money to go back to court.

It may depend on the court order. My court order states that STBX pays for sports & activities. It also states that he pays 1/2 of the uninsured and unreimbursed medical expenses.

The attorney is probably doing this just to see if he can get away w/it. My STBX tries to get away w/every single little thing he can, and I always have to "remind" him what the court order states.

Well, he's probably just pretty sure that she's not going to fight it.... but, I'm pretty sure that he'll find himself in deep doo if he doesn't pay up exactly as agreed.

On top of all of the other things here, usually a parent can not just subtract items, agreed upon or not, from the child support. Usually, he would need to supply her with a copy of the reciepts and ask for her half. If he is not paying her the full amount of cs, he's not paying his cs as far as the state and courts are concerned usually.
