I know of a family member that put up with a lot of that abusive behavior from an alcoholic. She finally got divorced and regrets not doing it much sooner. She feels her children were scared quite a bit.
I don't ever remember her recording him for any reason. I would certainly record him without hesitation if it were me and I felt that need. I tried to save some screaming on the cell phone once but somehow I lost it. Have you filed yet?

Well, the legality would depend on the day, the court, the judge, and the attorney... it wouldn't hurt to have it.... it's not "illegal" to have it... but it may not be "legally binding" in some circumstances... if that makes any sense.


However... if he called and made weird, whacked out threats on the speaker phone while you were at your sister's... you have real live, hearing, talking witnesses if needed.

I'm pretty sure the rule in most states is that you can only record someone with their permission. So, for instance, if he leaves you a nasty voicemail message...save it! That is permissable, but sneaking a tape recorder in your pocket probably won't be admissable in court.

If he is drunk or in a rage, simply say "I am going to record this, OK?" (and make sure that part is on the recording). Seriously -- my STBX was pulling some BS w/my son and I said "You think this is normal behavior? OK, I'm going to record it"
