If you had physical custody, I don't see how your ex could just decide on his own that your son should move w/o your permission, or how he even got registered in school.

The fastest way to end this nonsense...


* If xH owes 45k have him arrested for non payment of CS. That will get his atttention real quick. The courts will issue a bench warrant.


* Go to his house and have son removed and taken back to your house. In handcuffs if needed. That will send a message real quick.


* Get son back into Therapy.


* You are your son's mother. You also have a D decree that is a legally binding contract. xH can say he is the Man on the Moon but it does not make it so.


If you do not set things staright now I fear that you will loose your son.

In some states it is called "Specific Enforcement". Meaning that the terms of the Divorce decree must be followed.


As for the 45k he should be labelled a "Dead Beat Dad". I am not sure why your xH has not been arrested. Collecting CS is a state requirement and not doing can cost the state alot of $$$'s in terms of Federal Grants/Aid.


A 16 year old is still a minor in most states. He may have a little say but he is not an adult and cannot make that decision. You could always have your H charged with Parental kidnapping. You need an attorney that will fight for you.

Another tactic to use, you can request a copy of his Federal taxes for the years in question. If he says he paid the CS but did not report he is up the creek. That means he filed a false tax return.

I have never seen it declared as paid on the Federal Income Tax forms.

Child support isn't deductable, so it wouldn't be on a tax return anyway.
