Those who dealt/r dealing with custody..

battle. The last time we were in court the judge said we would be going to trial as ex's lawyer clamied Im interfering with the visitation and im not "mentally stable" all lies ofcourse. I really think this is ridiculouse that they are doing this and its a waste of time.

My question is and I will ofcourse address this with my lawyer before we go back to court May 22nd but arent or shouldnt both sides sit down and have a conference to see if there can be a settlement agreement and we can work things out and avoid a trial?

In my state it is mandatory to mediate before trial. You should ask your lawyer to set up a mediation. Even if you cannot resolve all of the issues, you can at least resolve some of them and only bring the issues you absolutely cannot agree on before the judge.

Most states will require that you go to mediation regarding custody before going to trial. As far as I know, very few custody disputes ever make it all the way to trial.
