The laws vary by state. I know that in my state (Wisconsin), everything is split up equally (assets as well as debts) unless the two people agree to something else. You can also get free lawyer representation if you show financial need (again, in my state) so maybe it's the same where you are?
You can call the family court commissioner's office, or your equivalent (if it's called something else there...I am pretty new at this too) and they are usually very helpful.

We do have the same pro bono type attorneys here where I live.
If he can't prove he's been working (and contributing to the house), then he's probably not going to get it.
