Update - Motion to reduce C/S

A few weeks back my X filed a motion to reduce his child support (that he never pays).
I received it on the 11th and had to have returned by the 16th.
So I hussled and bussled to get all of my information together (made copies for next time), showed that my proof of income at both of my jobs and what my insurance coverage is for my DD, daycare and on and on......EVERYTHING they needed. Wasn't going to make it to the Friend of the Court by the 16th so I faxed it. Told them in the fax that I was going to mail them the originals along with the confirmation of the fax showing that all my papers were received on their end. Mailed it.
A very wise friend of mine said as I was so angry that my X did this - it isn't the $$$ Lord knows I am doing it on my own and proud of it -- but it is his responsibility. We both wanted her etc... My friend said "Why do you want something from someone who doesn't want to give it to you for whatever reason he doesn't want you to have it..." (even though morally he should do it) I thought really long and hard about it and said the Friend of the Court (even though they suck in my county) let them do whatever. I did what I was supposed to do and if they lower it oh well it isn't like I get anything now anyway. P*** on them all if they reduce it for him.
Today I get in the mail from the Friend of the Court "The father's attorney filed a motion to change support on 11/8/05 on his behalf. She states there has been a change in the father's employment.... The father's attorney states teh father quit his job with ********* to start his own business in the ***** area and the attorney requested to have the father's income to be set at $300/wk....The father was earning an approx. income of $23,490.00 according to the original court order...The father was sent the same paperwork as the mother on 11/9/05 and was requested to return it on 11/16/05 as of the writing of this report the father has yet to return any income to this office...Because the father voluntarily reduced his income by quitting, teh father shall be imputed at this previous wages...the father's motion should be denied!!!!!"
I am soo happy - even though he still won't pay.....

I'm thrilled to hear that this has worked out the way it should! I completely agree with you... looking back, my xh was not the most responsible guy and even said he's sign away rights one day so he wouldn't have to pay, which I refused... Joey is here because of both of us and even though my xh is way far behind (over $10K), I have filed for full enforcement, which is a little harder to do right now since he lives in New Orleans... the good news is he is a police officer, so once their systems get fully running, it should be easier to collect.... but I look at it as a chance to hold him responsible for the one thing I can hold him responsible for... his child... who deserves all I can give him and so much more!

Woot!!!! Huge hugs...and may you someday get checks for arrearage in your mail when you most need it! *Smiles ... I know the stress and mixed feelings you were feeling before the appeal; I so wish I could say I am making it without his financial help...so far I am not, but I am trying. The days ahead when I can take care of 'us' without his supposed help won't come soon enough.
I think both parents should contribute in reasonably equitable ways depending on their income etc. to the childrens lives. Somewhere along the way to adulthood, I missed all the 'life isn't always fair' lessons I guess. I hope for a sane person to be the one who hears my stbx's devious request to reduce his cs to us and to cancel the arrearage and to instead make me pay him for back support...you know I would really owe him so much considering how he has so NOT paid anything regularly, in full, or on time for eleven months ...Annah.
