Thanks for those that responded to my question of whether or not the sale of a mutual house was considered income to non-custodial parent and subject to be included in child support amount. Any other thoughts are always welcome regarding that subject but now because my ex had paid child support $'s based on the house selling (and other income from his job as well) and now 2 1/2 years later; he wants the 3,500 back he says he shouldn't of paid. Well that money was used for living expenses for the children.
So now I've gone to child support services which in turn helped me as much as they could but suggested that I file a petition for modifying my divorce agreement. I've done all this, rather quickly I might add and now have a court date of Feb 15th.
I'm just wondering if the judge will rule that I need to pay my ex back when previously both of us thought (in good faith) that the house sale was to be included. Just a bit of info- the house sale is taking place in monthly payments over 8 years from our eldest son.
I know that the final ruling will be by the judge but has anyone every had this happen?
Also this is my first time to take him to court. What should I expect? I can't afford an attorney. Got pointers?
