What happens with the kids?

I've been for 8 years to my H we have 2 boys who are 1 and 3 years old. We recently moved closer to my family (both of his parents have passed away) and he hasn't been working for the past 2 years we've been here. He's tried different things, been offered 3 jobs, but passed on all of them. Bottom line I think he's finding any excuse not to work down here so we can move which is absolutely not going to happen again. My question is, since he told me tonight that he no longer loves me and he's deciding what to do now, is what happens with the kids in a divorced situation like this? We live in Calif. and I'm a stay at home mom. How do you split the kids up? 50/50? Doing this to the boys is the absolute worst part.

I have no idea what the general expectation is in CA. Find an attorney asap.

I doubt an unemployed X is likely to get 50% custody. Also, if he moves out of state he will have a much harder time getting signifigant custody time.

Your stbx may not want 50% custody. Have you asked him?

Mine wants me to have primary physical and share legal custody. We are lucky; there is no dispute there.

So, ask a lawyer and ask your stbx what he wants. Glad you have supportive family nearby.
