I've just joined this message board and thought not only could I get advice but I might be able to give some. Briefly I've been divorced for close to 4 years and am raising 2 girls on my own-ages 8 & 11. My question for the day is this though---My ex after 2 1/2 years of paying child support on his sale of 1/2 of our old house states that now he finds out that amount is exempt from child support and thus has paid me too much and wants me to repay him back. He has withheld Decembers support payment in lieu of a downpayment on what he states I owe. Has anyone heard of this type of exemption? He has paid some from his employment, which is ok but how about the sale of a mutual house?
Would appreciate any input thanks.

I would quickly find an attorney and maybe an accountant. You need to be protected. Take care of yourself and your family.

I would definitely contact an attorney in your area. I've NEVER heard of being ineligible for child support... it is for the children and they need that support, regardless of the money that one or the other parent may have... even if you're just building a college fund with it... it is something for your children's future...

As far as I know, in most states he cannot withold child support for ANY reason. It's not his decision, it's the state's decision. Do you have a child support order or agreement? If so, then he cannot just keep it. It's an entirely seperate issue.
