When does CS/Alimony start usually?

We have not signed the seperation agreement yet...my lawyer says that we should have it May 11th. Our date of seperation was May 1st. With my stbx's income change at each duty station I'm so clueless on how much support he'll even have to pay. I just want this finalized so that we can move on and I don't have to manage his life.

I know this is kind of confusing, sorry. I guess I was just wondering how long it is usually before you receive support...we're staying with a friend and have nothing and it's hard.

It really does depend on what state you will finally land in...VA, NC, SC, GA, FL (actually all the southern states) are going to range fairly the same amount. The midwest and west coast are higher b/c the cost of living is higher, that goes for the North too. Be careful about asking about payment though, you don't want to look like all you are after is the money...the courts look heavily on that!

In FL it commences immediately upon the signing of the separation agreement and in some cases is retroactive from the date that they left.

I belive in most states, the CS/alimony starts as soon as the separation agreement is signed. Plus, he can be ordered to pay back support from the actual date of your separation, not the date that he signed the agreement.

In Texas it starts 2 weeks after you file. I think it is different in every state.

I live in Ohio. My official child support (through the agency) doesn't start until we go to court and it is final. My attorney did say that my stbx must pay me directly until we go to court (we have a signed legal separation), otherwise he will be considered in arrears. Ask your attorney.
