Will the check clear or not?

Hey guys,
This is SUCH a problem. XH has decided that he wants to start paying me every week instead of bi-weekly. He sees the children every other weekend ( for the most part ) and just started paying again after a lapse costing me over 1500.00. Anyway, when he picked up the kids last week he decided to give me one check for last week and post date another check for this week, making his payment schedule every week. Good right?
Wrong.

I honestly believe that all abusers have a problem with checks, Angelena! I really do! My STBX decided to make a house payment (he wanted to look good in court) and it bounced. The mortgage company is now calling again and has sent me a foreclosure notice. I have turned this over to my atty. who will bring it up at our final hearing next week. Every time the courts order him to pay for something, he writes a check and it bounces.
I refuse to take a personal check from him (not that he has even offered one) for alimony or child support. He has been cited for contempt of court because of it and will hopefully land in jail next week. Where I live, the courts have started to put deadbeat parents in jail with a minimum sentence of 90 days. If they continue not to pay, then it goes to a year. They've changed the law from civil to criminal. I think all states should follow that criteria, don't you? Without sever consequences for nonpayment then they will continue to do this.
Children suffer the consequences either way and that is not right! No child should suffer just because the parents get divorced. EVER!

P.S. Garnishing your EH's wages might work, but if he is anything like mine, he will change jobs everytime his wages are taken.
Well, the garnishment would definitely help.
Ya know... if the check isn't good... it really is a consequence for him.

Funny you should mention that. In the few weeks before he was giving me cash. I would give him a written receipt. I think that is how I knew last week's check would be bad. He all of a sudden said " can i write you check instead?" I sort of thought, hmmmmmm.
I think garnishment is next. Your right.
