Melanie, I've been following your story closely. Please know you will be in my prayers on Tuesday. Hopefully the judge will see through this. Keep us posted if you can. Huge hugs.
I don't think judges usually hesistate to put parents in jail because their children need them. If that was the case, then parents would be less accountable under the law than people without children. I don't think you should go to jail though, and I hope the GAL makes the arguement that this is more about your ex and what he's done to you (since the GAL knows you all so well) than about your dd needing you. Of course your dd needs you, but that won't get you a free pass in the judges eyes necessarily. The fact you have been manipulated throughout all of this might get you a pass, and I hope the GAL can help the judge see that (and if so, then of course your dd benefits as well).
I agree with you firstamendment, but most judges should look at each situation as unique and because of my X's neglect and abuse towards me and the kids, it should
Can I ask what the worst case scenario is? If the judge doesn't give you home detention, how long would you face? I am sorry you have to go through all this, it has to be so incredibly hard I can't imagine.
Thank you so much for your well wishes!
