X's reasons for new trial

I met with my lawyer today and they gave me a copy of why x is requesting a new trial. Mostly it is because of cs but one part is truly funny.


The Movant (him) and Respondent (me) reconciled and lived together as husband and wife from Feb 2007-Dec 2007 (dates are wrong. I moved back in at the end of May). The Respondent led Movant to believe that their relationship was not in conflict (He had a girl friend and was openly cheating) when suddenly Respondent left Movant (he kicked me and the kids out at 11pm with no way to go and no money saying he would give me money when a judge made him) and set final hearing without telling Movant or giving any indication that a divorce was being sought (just the two conversations we had about him helping me pay for the rest of it so we could get it over faster and about what my lawyer had to say after I saw her)

So, basically, he's claiming the end of his marriage was a "surprise" and he was the "surprised" person?


What does your attorney say about having to rehash the divorce? Also, wasn't your divorce by default because your Ex refused to respond to the papers?


What a loser he is!


P.S. If this does go forward, be sure you ask for somethings yourself like: college tuition for yourself so you get a good job, tuition for your children to attend school now and college, half his retirement, and all your legal expenses. ;-)

It was a default divorce. My lawyer said the judge we have will take no crap from him. I just have to go testify he kicked us out. His lawyer is claming I led him to believe he did not have to respond to the papers and I had stopped the divorce.
